Published this Tuesday, the document is meant to feed public debate and the forthcoming trade-offs, while European law already pushes to distinguish genuine independents from false ones. The recommendations remain those of a mission: they do not have the force of law.

The mission therefore refuses to make the employment contract the sole lever. It judges it more useful to speed up litigation and rebalance the burden of proof, in order to address situations of dependence without reclassifying all independents a priori.

This judicial path, already taken, relies on convictions. French courts have already convicted platforms such as Deliveroo or Frichti for undeclared work.

The report does not substitute a single status for the diversity of platform occupations. It insists on strengthened social rights through procedural mechanisms, rather than through a general presumption of employee status.

Those targeted include, in particular, meal delivery workers, domestic helpers and VTC drivers. The document, the fruit of more than 80 hearings, sets out around thirty recommendations.
