Issued from the 2015-2017 state of emergency, these provisions were transposed into ordinary law by the Silt law of 30 October 2017. They include a perimeter assignment, often the size of the municipality, a daily check-in at the police station or a ban on appearing.

Lawyers, unions and associations deplore the use of individual assignment orders, based on legal tools designed for terrorism. A very large part of these decisions, in force from Friday evening to Sunday evening, relies on individual administrative control and surveillance measures (Micas).

These advocates have referred the matter to the Council of State, notably because of orders preventing demonstrators from going to a gathering point. In principle, activists can challenge the orders in summary proceedings before the administrative court.

When questioned, lawyer Raphaël Kempf considers that “dikes (…) burst from the moment the Interior Ministry started qualifying the actions of 17 October as terrorist.” A movement also attributes to an activist the “diversion of a procession taking 250 people off the declared route” that day, whereas according to him it was a collective will.

Aïnoha Pascual, lawyer for several activists, estimates along with other colleagues that at least around sixty people were affected by Micas for the weekend of 31 October. According to her, no evidence justifies “their link with a terrorist entity.”.
